<p>Hamas has controlled about 60 Palestinian local authorities in the West Bank, since a municipal elections in 2005.</p>

<p>According to the Palestinian Basic Law, death sentences are to be approved by the president, but according to Hamas, Mahmoud Abbas&#8217; tenure ended on 8 January 2009.</p>

			<content:encoded><![CDATA[<p>Minister of justice Mohamed Al-Ghoul in the de facto government in Gaza has issued a press release stating that &#8220;any actions, decisions or obligations made by former PA chief Mahmoud Abbas, whose term of office had expired on 9/1/2009, do not oblige the Palestinian people.&#8221; Ghoul refers to Art 36 in the Palestinian Basic Law, which states that the presidential term of office is only four years. Accordingly Abbas is no longer entitled to represent the Palestinian people or sign agreements on their behalf even by declaring himself a president of Palestine</p>

			<content:encoded><![CDATA[<p>According to recent media reports, Hamas lawmakers have allegedly ratified part of a new legal code based on Islamic teacings. These reports have now been rejected by head of the legal committee for the Palestinian Legislative Council (PLC) in Gaza. Punishments under the new law reportedly included the death penalty, ransoms, imprisonment, fines, confiscation and dismissal from a place of employment. According to PLC member Ahmad Abu Halabiyya, the topic had been discussed in a workshop, not in the PLC.</p>
